A lawsuit has been initiated against Eataly, an Italian restaurant and store chain, by a woman who asserts that she sustained an injury due to slipping on a piece of prosciutto within one of their Boston stores, resulting in a broken ankle.
The plaintiff, Alice Cohen, hailing from New Hampshire, was in the vicinity of the store's food sampling area when the incident occurred. The legal complaint alleges that she "slipped and fell on a piece of prosciutto on the floor, injuring her left ankle and causing a fracture."
According to the accompanying statement detailing the damages in the lawsuit, Cohen suffered a sprain in her left ankle along with a distal fibular avulsion fracture. Avulsion fractures commonly manifest symptoms such as swelling, pain radiating to adjacent areas of the body, and difficulties walking or limping, as indicated by the Cleveland Clinic.
Submitted in the Suffolk County Superior Court in Massachusetts, the lawsuit, filed by both Cohen and her husband, charges the store with negligence and breach of its duty of care, contending that they failed to maintain a safe floor environment.
As a result of the slip incident in October 2022, Cohen has reportedly endured substantial pain, suffering, and a diminished quality of life. The damages statement reveals that she incurred expenses amounting to $2,104 for hospital fees, $170.68 for medical consultation fees, and $5,265 for physical therapy expenses.
Furthermore, the lawsuit asserts that Cohen's husband experienced a reduction in the quality of their spousal relationship due to the mishap.
The legal action seeks compensation for the alleged injuries and associated damages suffered by Cohen, as well as the loss of consortium experienced by her husband. Additionally, a trial by jury is being pursued.
Neither Eataly nor the Cohens' legal representatives have provided an immediate response to a request for comment made by Insider outside of regular business hours.
