Cargill is reportedly planning to appeal a regional court's judgment in Brazil that ordered the company to pay a $120,000 penalty for purchasing cocoa allegedly sourced from farms where child or forced labor was detected.
The ruling from the 39th labor court in Bahia, Brazil, also required Cargill to include clauses in its future contracts within the region for any commercial dealings with enterprises known to have human rights issues.
However, in response to the court case held last week, Cargill emphasized that it does not condone any form of human trafficking or child labor within its supply chains. These issues are contrary to its commitment to the Cocoa Promise framework, which plays a crucial role in its operations.
While Cargill is subject to the decision of the Brazilian Superior Labor Court, which keeps the case under judicial conditions, the company confirmed its intention to appeal the verdict in a higher court.
In a general statement, Cargill reaffirmed its strong stance against human trafficking, forced labor, and child labor, asserting that it actively works to protect human rights and children's rights globally. The company aligns with the United Nations Sustainable Development Goals (SDGs) and is dedicated to eliminating child labor.
Cargill also highlighted its comprehensive approach to addressing these issues, including rigorous supplier checks against government embargo lists in Brazil, with immediate suspension for identified violations.
The statement underlined Cargill's commitment to the "Cargill Cocoa Promise" program, which encompasses regions of origin in Brazil. Additionally, the company is a signatory to the "Cocoa Action" initiative, a pre-competitive effort that unites various stakeholders in the cocoa supply chain to advance sustainability goals.
With over 56 years of presence in Brazil, Cargill emphasized its unwavering commitment to adhering to all relevant laws and regulations governing its business operations. The company takes this commitment seriously and expects its suppliers and partners to share its dedication to prioritizing the safety, well-being, and dignity of individuals.
